SUBSCRIPTION TERMS (SIM / TELECOM / MDM SERVICES/ SOFTWARE)
1. Overview
These Subscription Terms apply to all communications and technology services offered by Volcron (“VLCRN LTD”) including, but not limited to, mobile data SIMs, telecom connectivity, voice or broadband services, software licensing, and mobile device management (MDM) solutions.
Volcron Connected Devices acts as a reseller, agent or intermediary for various network operators and wholesale service providers (such as BT, EE, Vodafone, O2, and others). Accordingly, the specific Terms & Conditions, Service Level Agreements (SLAs), and Acceptable Use Policies applicable to each service are those of the underlying network or service provider and will vary depending on the product or tariff selected.
Before any service is activated, customers will receive and must agree to the relevant provider’s full Terms & Conditions and Service Agreement, which shall govern the ongoing use of that specific service.
VLCRN’s responsibility is limited to facilitating the order, activation, and billing arrangement where applicable, unless otherwise stated in writing.
2. Contract Term
Contract duration will vary depending on the selected service and provider. Typical minimum terms are 30 days, 12, 24, 36, or 60 months. The exact contract length, renewal, and cancellation policies are governed by the service provider’s agreement issued to the customer prior to activation.
Volcron will notify customers of the applicable term during quotation or order placement and confirmation.
3. Billing & Payment
Where VLCRN invoices the customer directly, billing will occur monthly in advance via direct debit or invoice terms agreed at order.
Where the provider bills the customer directly, their own billing terms and payment schedules shall apply.
Failure to make payment within the stated timeframe may result in service suspension or termination in accordance with the provider’s terms.
4. Auto-Renewal & Termination
Renewal and termination procedures differ per provider.
Customers are responsible for reviewing and complying with the cancellation and notice requirements specified by their contracted provider.
Smart Rugged Devices will assist in submitting termination requests to the relevant supplier but cannot override provider notice periods or early-termination charges.
5. Service Levels & Support
Service performance (including uptime, latency, and repair targets) is governed by the network or platform provider’s SLA.
VLCRN provides first-line support to liaise between the customer and the provider but is not responsible for network outages, maintenance, or delays beyond our direct control and any compensation requests would be under t&c’s of your network/service provider
Planned maintenance and fault resolution times are determined by the underlying carrier or service provider.
6. Fair Use & Acceptable Usage
Each provider enforces its own Fair Use Policy and data or usage limits which are provided at point of sale.
Excessive, abusive, fraudulent, or prohibited usage as defined by the provider may lead to service restriction or termination.
Customers are expected to use all services for legitimate business purposes and in compliance with UK law and the provider’s acceptable use policy.
7. Liability & Disclaimer
Vlcrn shall not be liable for loss of data, network unavailability, or consequential damages resulting from provider performance or outages.
Where Vlcrn is not the principal provider, liability for service delivery, uptime, and continuity rests with the respective carrier or platform operator.
Vlcrn aggregate liability in connection with any directly supplied service shall not exceed the total fees paid to VLCRN for that service in the preceding twelve (12) months.
8. Provider Terms Supremacy
In the event of any conflict between these Subscription Terms and the applicable provider’s Terms & Conditions, the provider’s terms shall take precedence for that service.
Customers are advised to review and retain a copy of all relevant provider agreements before activation or renewal.
9. Governing Law
These Subscription Terms are governed by and construed in accordance with the laws of the United Kingdom and are subject to the exclusive jurisdiction of its courts.
